Appeal (Canadian Law)

To ask a more senior court or person to review a decision of a subordinate court or person. In some countries such as Canada, the USA and Australia, appeals can continue all the way up to the Supreme Court, where the decision is final in that it can no longer be appealed. That is why it is called "supreme" (although, in Australia the supreme court is called the High Court ).

Appeal (Congressional)

A member’s challenge of a ruling or decision made by the presiding officer of the chamber. In the Senate, the senator appeals to members of the chamber to override the decision. If carried by a majority vote, the appeal nullifies the chair’s ruling. In the House, the decision of the Speaker traditionally has been final; seldom are the appeals to the member to reverse the Speaker’s stand. To appeal a ruling is considered an attack on the Speaker.

Appeal (Criminal Justice)

Following a conviction, the convicted person may apply for his or her case to be brought before a higher court in order to "appeal" the previous judgment of the case. All states allow some kind of appeals process, but it varies from state to state. Most allow two appeals: one "as of right" to an intermediate appeals court, and the second as a "discretionary" appeal to the state's highest appeals court. The second appeal is called discretionary because the court can decide whether or not to take the case. The intermediate appeals court has no choice about taking the first appeal.
