Grandfather Clause (Advocacy)

A provision exempting persons or other entities already engaged in an activity from new rules or legislation affecting that activity. Grandfather clauses are sometimes added to legislation to avoid antagonizing groups with established interests in the activities affected.

Grandfather Clause (Customs)

A provision in a legal instrument, such as GATT, that allows countries that accede to it to maintain preexisting domestic legislation inconsistent with provisions of that instrument.

Grandfather Clause (Finance)

A provision included in a new rule or regulation that exempts a business that is already conducting business in the area addressed by the regulation from penalty or restriction.

Grandfather Clause (International Economics)

A provision in an agreement, including the GATT but not the WTO, that allows signatories to keep certain of their previously existing laws that otherwise would violate the agreement.


Grandfather Clause (Natural Gas)

The continuation of a former rule, clause, or policy (usually in a contractual agreement) where a change to a new rule or policy would be patently unfair to those covered by the former.


Grandfather Clause (Parliamentary Procedure)

(clause de droits acquis) - A clause protecting a prerogative of an individual or a collectivity from being affected by the new legislation.


Grandfather Clause (Real Estate)

The clause in a law permitting the continuation of a use, business, etc., which was permissible but because of a change in the law is now no longer permissible.


Grandfather Clause (Shipping)

The General Agreement on Tariffs and Trade (GATT) provision that allows the original contracting parties to exempt from general GATT obligations mandatory domestic legislation which is inconsistent with GATT provisions, but which existed before the GATT was signed. Newer members may also "grandfather" domestic legislation if that is agreed to in negotiating the terms of accession. (U.S. legislation also provides for "grandfather clauses.")
