Notice (Class Action)

A court ordered document which informs class members of the nature of proceeding and their rights and responsibilities in the litigation.


Notice (Copyright)

Once required by law, a proper copyright notice had to include the copyright symbol (Ó), the date, and the name of the copyright owner. Works that did not bear a proper copyright notice entered the public domain upon publication. A copyright notice is no longer required and the lack of a notice, except in older works where it was required, is no longer a good indicator that the work is in the public domain.


Notice (Internet)

Refers to data collector's disclosure of their information practices prior to collecting personal information from consumers.

Formal notification to the party that has been sued in a civil case of the fact that the lawsuit has been filed. Also, any form of notification of a legal proceeding.

Notice (Personal Injury Law)

Formal notification to the party that has been sued in a civil case of the fact that the lawsuit has been filed. Also, any form of notification of a legal proceeding.


Notice (Trademark)

Notice of trademark rights is given by use of the symbols, TM, SM or ®, or by phrases such as "XYZ Company is the registered owner of the trademark ABC," or "Reg. U.S. Pat. Off." The symbols "TM" and "SM" are used for trademarks and service marks respectively, and provide notice that a company considers its use of a mark to be protected by trademark laws, even though the mark is not federally registered. Use of the "®" symbol gives notice specifically of the existence of a federal trademark registration.Failure to provide notice of federal registration can result in the court denying certain monetary awards, unless the plaintiff can prove the defendant actually knew the mark was registered.
